Maine voters, please tell legislators that you oppose
LD 1323, the bill that would overturn the rockweed court decision

On Thursday May 23, the ACF Committee of the Maine legislature votes on LD 1323. As currently written, LD 1323 would reverse the Maine Supreme Court 2019 decision that rockweed is the property of the intertidal landowner.

Here is the problem: Making intertidal seaweed, now private property, into public property without compensating those who own the seaweed, is an unconstitutional “taking”.

As the Chief Legal Counsel to Gov. Mills stated to the ACF committee during public hearing: (our paraphrasing): the issue is not whether you can pass a bill, the issue is whether the bill you pass is constitutional.

Listen to the work session on this bill on May 9:
Part 1
Part 2

The committee ended the work session on LD 1323
Now, on May 23, they WILL VOTE.

IF, and ONLY IF, you vote in Maine:

call and leave a message for each committee member on the ACF committee (Agriculture, Conservation, Forestry).

Long messages will not be conveyed to the legislator!

State your name, the member’s name, your town, and that you are opposed to LD 1323 as written, and why (the bill is an unconstitutional taking of intertidal seaweed, which the Supreme Judicial Court has declared is private property.)

Please leave a message for each committee member below, using the phone number provided, and finish your calls by 3 pm Wednesday May 22.

If you do not vote in Maine, please do not call at this time. We appreciate your support!

Acadian Seaplants has been calling landowners recently to ask them if they give permission for rockweed harvesters to take their rockweed.

If you are called, we hope you will “just say no”.
